Terms of Service

These Terms of Service (“Terms”) are an agreement between you and WEBSHUNYA STUDIO (OPC) PVT LTD, the company that operates GMBIQ at gmbiq.com (“GMBIQ”, “we”, “us”, or “our”).
GMBIQ connects with Google Business Profile to help businesses view customer reviews, prepare AI-assisted reply drafts, publish approved replies, and use related review-management features.
By creating an account, connecting a Google Business Profile, or using GMBIQ, you agree to these Terms and our Privacy Policy.
Who Can Use GMBIQ
You may use GMBIQ only if:
- You are at least 18 years old
- You can legally enter into an agreement
- You have authority to act for the business you register
- You are authorised to manage every Google Business Profile you connect
- Your use of GMBIQ is permitted under applicable law
If you use GMBIQ for a company or another organisation, you confirm that you have authority to accept these Terms on its behalf.
Your Account
GMBIQ uses Google APIs to display permitted Business Profile information, help you manage reviews, and publish replies you approve.
GMBIQ’s use and transfer of information received from Google APIs will comply with the Google API Services User Data Policy, including its Limited Use requirements.
Subscription, Billing and Payment
Current free period
GMBIQ is currently available free of charge during an introductory three-month period. No subscription fee will be charged during this period, and no payment is required simply to use the free version.
Future paid plans
We may introduce paid plans after the free period. Pricing, billing cycles, included features, taxes, renewal terms, and any usage limits will be shown clearly before a paid plan begins.
We will not automatically charge you merely because the free period ends. Before any payment is taken, you will be asked to select a paid plan, review the applicable price and billing terms, provide or confirm a payment method, and authorise the charge.
If you do not choose a paid plan, we may limit, pause, or close access to paid features after giving reasonable notice. Where paid subscriptions are introduced, payments will be handled by a payment service provider, and additional checkout terms may apply.
We may change future plan prices or features. Any change affecting an active paid subscription will be communicated before it takes effect, and any rights required by applicable law will remain available.
No-Refund Policy
No refund issue arises while you use GMBIQ without charge during the introductory free period.
If paid plans are introduced, payments will generally be non-refundable once a billing period begins, unless a refund is required by law or stated in the plan or checkout terms. We may review requests involving duplicate charges, unauthorised payments, billing errors, or serious service failures.
To report a payment problem, email support@webshunya.com with your account email, transaction details, and a short explanation. Nothing in this section removes any refund right that cannot legally be excluded.
Payment failures: If a payment fails, we will retry up to 3 times over 7 days. After that, your account may be
suspended until payment is resolved. You will retain access to your data during the grace period.
Cancelling Your Subscription
During the free period, you can stop using GMBIQ or request account deletion at any time.
If you later choose a paid subscription, the cancellation method and the date on which cancellation takes effect will be displayed with that plan. Unless different terms are shown before purchase, cancellation will stop future renewals and access will continue until the end of the paid billing period.
Deleting an account is different from cancelling a subscription and may permanently remove access to stored information. Our Privacy Policy explains how account and Google-connected data are handled after deletion.
Google Services and Account Access
GMBIQ is an independent service and is not owned, operated, or endorsed by Google. Your Google account, Google Business Profile, listings, reviews, and related Google services remain subject to Google’s terms, policies, systems, and decisions.
Google may change or discontinue APIs, restrict a profile, remove content, reject a reply, or suspend an account. GMBIQ does not control those actions and is not responsible for an interruption or loss caused by Google’s systems or decisions, except where applicable law states otherwise.
You are responsible for following Google’s applicable terms and Business Profile policies. You must not use GMBIQ to buy, create, solicit, exchange, or manipulate fake reviews.
GMBIQ’s use and transfer of information received from Google APIs follows the Google API Services User Data Policy, including its Limited Use requirements. You can remove GMBIQ’s access through the platform, where available, or through Google’s third-party connections page.
AI-Generated Content
GMBIQ uses AI to help prepare draft replies. AI output may be inaccurate, incomplete, unsuitable, or inconsistent with your business voice.
Unless you deliberately enable an automatic publishing feature, you can review, edit, approve, or reject a draft before publication. You are responsible for the final content published from your account, including its accuracy, tone, legality, and compliance with Google’s policies.
Do not include confidential information, sensitive personal information, or anything you are not authorised to use in instructions sent to the AI. GMBIQ does not promise that a suggested reply will produce a particular rating, customer response, or business result.
As between you and GMBIQ, you may use the output created for your account, subject to applicable law, these Terms, and any rights belonging to others.
GmbIQ’s use and transfer of information received from Google APIs adheres to the Google API Services
User Data Policy, including the Limited Use requirements.
Acceptable Use
You must not use GMBIQ to:
- Break the law or violate another person’s rights
- Violate Google’s terms or the terms of another connected service
- Create, purchase, request, exchange, or manipulate fake reviews
- Publish spam, threats, harassment, discrimination, defamatory material, or unlawful content
- Reveal confidential or sensitive customer information in a public reply
- Upload malware or interfere with the security or operation of GMBIQ
- Bypass access controls, usage limits, or technical restrictions
- Scrape, reverse engineer, copy, or attempt to obtain GMBIQ source code, except where the law expressly permits it
- Use automated methods that place an unreasonable load on the service
- Resell, sublicense, redistribute, or white-label GMBIQ without written permission
- Use GMBIQ data or output to train a competing AI model or build a competing service
We may investigate suspected misuse and take reasonable steps to protect GMBIQ, its users, and third parties.
You are always in control. GmbIQ never publishes a reply to Google without your explicit approval. The AI
drafts — you decide.
Intellectual Property
GMBIQ and its software, design, branding, website content, documentation, and related technology belong to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable, and revocable right to use GMBIQ for its intended business purpose. They do not transfer ownership of the platform or our intellectual property to you.
You keep ownership of content you submit or create. You give us a limited, worldwide, non-exclusive licence to host, process, transmit, display, and otherwise use that content only as needed to operate, secure, support, and improve GMBIQ.
If you send feedback or suggestions, we may use them without payment or an obligation to implement them. You must have the necessary rights to any content you provide to GMBIQ.
Privacy
Our Privacy Policy explains what information we collect and how we use, share, retain, and protect it. It also explains how Google user data and AI-related processing are handled.
By using GMBIQ, you acknowledge that your information will be handled as described in the Privacy Policy. If you manage information for another person or business, you are responsible for having any permission required to provide or use that information.
Third-Party Services
GMBIQ depends on third-party services, including Google and providers supporting AI, hosting, databases, communications, analytics, support, and future payment processing.
Those services may have their own terms and privacy policies. We do not control their systems and cannot guarantee that they will always be available or unchanged. We are not responsible for a third party’s independent actions, except to the extent responsibility cannot be excluded under applicable law.
Disclaimer of Warranties
GMBIQ is provided on an “as available” basis. We work to keep the platform reliable and secure, but we do not promise uninterrupted or error-free service.
To the maximum extent permitted by law, we do not make warranties about merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or results. We do not guarantee that AI drafts will be correct, that Google will accept or display a reply, or that using GMBIQ will improve ratings, revenue, visibility, or customer relationships.
Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT.
To the maximum extent permitted by law, GMBIQ and WEBSHUNYA STUDIO (OPC) PVT LTD will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for loss of profit, revenue, goodwill, business opportunity, or data arising from your use of, or inability to use, GMBIQ.
Where liability can legally be limited, our total liability for all claims relating to GMBIQ will not exceed the fees you paid to us for the service during the 12 months before the event giving rise to the claim.
These limits do not apply to liability that cannot be limited or excluded under applicable law. They also do not reduce any mandatory rights available to a consumer.
Indemnification
To the extent permitted by law, you agree to compensate WEBSHUNYA STUDIO (OPC) PVT LTD for reasonable losses, claims, liabilities, and legal costs arising from:
- Content you submit or publish through GMBIQ
- Your unlawful or unauthorised use of the service
- Your breach of these Terms
- Your violation of Google’s terms, another person’s rights, or applicable law
This obligation applies only to matters caused by your acts or omissions and does not require you to compensate us for losses caused by our own wrongdoing.
Suspension and Termination
We may restrict, suspend, or terminate access if we reasonably believe that:
- You have seriously or repeatedly breached these Terms
- Your account is being used unlawfully, fraudulently, or without authorisation
- Your use creates a security, legal, or operational risk
- A payment remains overdue after paid plans are introduced
- We are required to act by law, a court, a regulator, or a service provider on which GMBIQ depends
Where practical, we will explain the reason and provide an opportunity to resolve the issue. We may act immediately when necessary to protect users, data, systems, or third parties.
You may stop using GMBIQ at any time. When access ends, provisions that are intended to continue will remain effective, including those concerning ownership, liability, indemnification, disputes, and general legal terms.
Changes to These Terms
We may update these Terms when GMBIQ, our business model, legal requirements, or third-party services change. The updated date will appear at the top of this page.
For a material change, including the introduction of paid plans, we will provide reasonable advance notice through GMBIQ, by email, or by another appropriate method. If your agreement is required before a new charge or material term applies, we will ask for it. Continuing to use GMBIQ after other updated Terms take effect means you accept those Terms.
Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Before starting formal proceedings, you and GMBIQ agree to make a reasonable attempt to resolve the dispute by contacting the other party and discussing the issue in good faith.
If the dispute is not resolved, the courts in Ahmedabad, Gujarat, India will have jurisdiction, subject to any mandatory right you may have to bring a claim elsewhere under applicable consumer law.
General
- Entire agreement: These Terms and the Privacy Policy form the agreement between you and us concerning GMBIQ and replace earlier discussions or statements about the same subject.
- Severability: If a court finds one provision unenforceable, the remaining provisions will continue to apply.
- No waiver: A delay or failure to enforce a provision does not waive our right to enforce it later.
- Assignment: You may not transfer these Terms without our written consent. We may transfer them as part of a merger, restructuring, financing, or sale of the business, subject to applicable law.
- Force majeure: Neither party is responsible for delay or failure caused by events reasonably beyond its control.
- Notices: We may send notices to the email address registered to your account. You may send legal or service notices to the email listed in Section 19.
- Headings: Headings are included for convenience and do not change the meaning of these Terms.
- No partnership: These Terms do not create an employment, agency, partnership, franchise, or joint-venture relationship between you and GMBIQ.
